About Used Rail R50 R65

The chemical composition is the standard for original R-50 R-65 Tee rails weighing 50 pounds per yard or more, 6 meters long and more. Material to be rolled into bars and shapes. Free of bent and twisted rails, frogs, switches and guards, rails with divided heads and broken flanges. A continuous welded rail may be included as long as there are no welds greater than 9 inches from the end of the rail part. Free of lint, non-ferrous inclusions, excessive rust and other impurities. War-free and explosives, cartridges, cartridges, other weapons and ammunition used or not and any container closed. Free of any radioactive material, any harmful chemical, substances and coatings, any organic waste and any other harmful substance. Dirt, dust, lint and other impurities are not allowed more than 05%. The rails should be grouped carefully and secured with iron wire or straps, equipped with suitable lifting hooks.

Free of concrete, dirty and strange material of any kind. The rails can be cut to the length desired by the buyer, as long as it assumes the cost of the mentioned work.

2. AFTER BOTH PARTIES HAVE AGREED ON THE TERMS AND CONDITIONS OF THE DRAFT CONTRACT, BUYER SIGNS CONTRACT AND SEND TO SELLER TO SIGN. THEN EACH PARTY EXCHANGES THE SIGNED CONTRACT IN A PDF FORMAT AND SEND BY EMAIL TO ONE ANOTHER. EACH PARTY THEN LODGE THE CONTRACT WITH THEIR RESPECTIVE BANK
3. WITHIN 5 BANKING DAYS AFTER SIGNING THE CONTRACT, BUYER ISSUES PROOF OF FUNDS (POF) IN FORM OF BANK COMFORT LETTER (BCL) AND ALSO VERBIAGE OF LETTER OF CREDIT TO SELLER FOR CONFIRMATION
4. WITHIN 5 BANKING DAYS AFTER SELLERS BANK CONFIRMS THE BCL WITH BUYERS BANK AND APPROVES THE DRAFT LC, SELLER OFFICIALLY INVITE BUYER TO INSPECT STOCKS IN AT LEAST TWO STOCK YARDS BEFORE ISSUE OF LC TO SELLER’S BANK
5. WITHIN 5 BANKING DAYS AFTER BUYER’S SATISFACTORY INSPECTION OF TWO OF THE STOCK YARDS, THE BUYER ISSUES DLC MT 700 TO SELLER’S BANK FOR THE TOTAL VALUE OF THE TRIAL ORDER
6. WITHIN 3 BANKING DAYS AFTER CONFIRMATION OF MT 700 BY SELLERS BANK, SELLER WILL ISSUE THE BUYER BANK 2% PERFORMANCE BOND FOR THE TOTAL VALUE OF MT 700
7. AFTER THE CONFIRMATION OF PERFORMANCE BOND BY BUYERS BANK, SELLER WILL BEGIN THE EXECUTION OF BUYERS ORDER AND COMPLETES THE SHIPMENT NOT MORE THAN 35 DAYS AFTER BUYER BANK CONFIRMS THE ISSUE OF PER FORMANCE BOND
8. IMMEDIATELY AFTER SHIPMENT IS COMPLETED AND RELEVANT DOCUMENT IS RECEIVED AS SIGHTED BY THE BUYER’S BANK, 90% OF THE TOTAL VALUE OF SHIPMENT SHALL BE RELEASED TO THE SELLER’S BANK WITHIN 72 HOURS
9. AFTER GOODS IS INSPECTED BY SGS AT THE DESTINATION PORT AND CERTIFICATE OF COMPLIANCE WITH AGREED QUALITY AND QUANTITY AS WRITTEN IN THIS CONTRACT, THE BUYER SHALL BY TELEGRAPHIC TRANSFER (TT) WITHIN THREE BANKING DAYS TRANSFER THE BALANCE OF 10% OF THE VALUE OF THE TOTAL SHIPMENT TO THE SELLER’S DESIGNATED ACCOUNT
10. ONCE STEP NINE UNDER THE PROCEDURE IS FULFILLED, A NEW DLC WILL BE ISSUED BY THE BUYER TO THE SELLER TO CAPTURE THE TOTAL VALUE OF THE NEW QUANTITY OF xxx MT AND SAME SHALL BE ROLLOVER FOR SUBSEQUENT MONTHLY DELIVERY.

ESCROW PROCEDURES

PROCEDURES (Amended as per COVID)
1. Buyer issues LOI (Addressed to BSD Traders EA Ltd via Abu Faisal International Pvt Ltd)
2. Seller responds with FCO
3. Buyer countersigns FCO. Additionally, the buyer shares the ICPO attached with Proof of Funds (POF). Proof of Funds can be shared by Buyer’s bank to the Seller’s Bank via secure mail. The buyer’s bank should confirm the availability of funds to expedite the deal as per the ICPO
4. Seller shares the SPA (open for amendments) once the POF is verified by the seller’s bank or seller’s attorney.
5. The buyer and seller works together to reach an agreement on the terms of the SPA. Once both parties agree to the terms of the SPA, the seller provides to buyer's bank via secure mail, the following documents :
- Certificate of product origin issued by the Kenyan Chamber of Commerce or (DTI)
- Letter of Commitment to supply the product - product availability based on the terms of the SPA
- Passport of the product (Conducted in the refinery reservoir)
- Export license of the seller and copy of approval to export (Issued by the relevant ministry in Kenya - Ministry of Energy /Ministry of Justice)
- Tax Clearance Certificate
- Commercial Invoice for the trial shipment quantity
6. Further to verification of documents, buyer coordinates with the seller or his attorney to open an escrow account in Kenya transferring 50% of the invoice amount. The terms of the escrow account will clearly instruct the seller ( BSD EA Ltd ) cannot receive or access the fund in any manner unless final shipping documents are verified by the seller and the inspection agency. The escrow provides enough guarantee for the seller to proceed with logistics and labour for the transaction while protecting the buyer's fund until final product shipping documents are provided.
7. Seller proceeds to initiate logistics and labour for the transaction. If required, the product will be cut to the buyer's required specification. The seller's client executive will be updating the buyer's team about complete transactional proceedings.
8. Seller issues the following POP documents to the buyer and buyer’s bank. Furthermore, the seller sends a scanned copy to the buyer’s secure mail id.

- Allocation Certificate (Transaction Deal Passport)
- Tax Clearance Certificate
- Ministry of Energy Affidavit
- Cargo Manifest
Note : If the required buyer can perform quality and quantity tests on his behalf (CIQ / SGS)
9. The buyer approves to release 50% of the escrow amount to the seller. Additionally, the buyer initiates the transfer of the additional 50% of the invoice via TT to the seller.
10. Upon on the receipt of money by the seller, shipment commences as scheduled in the SPA.

1. Signed Commercial invoice showing Contract No, Seal No, Container(s) No and Name of carrying vessel and shipment number in three original plus one copy
2. Clean on-Board Ocean Bill of Lading issued and signed by the carrier/ master, made out to order, bank endorsed and marked “Freight Prepaid” notify applicant
3. Original clean on board signed Packing Lists in three original plus one copy
4. Certification of Weight and Quality to be issued by SGS OR Bureau Veritas in one original showing the chemical content of the product and specification
5. Certificate of Origin in one original
6. Certificate of ownership /Legalization
7. Certificate on non-radiation
